Liability

An OEM contractor is not an airbag for businesses that enter unsafe jurisdictions in any way. An OEM partner (engl. Trader) does not insure import risks, but can only help to keep them as low as possible and to point them out clearly! More.

Porcelain - even if everyone knows it - is not a simple material in itself. It requires a number of concrete components so that in the end the term "porcelain" really applies and not just looks like porcelain. Porcelain is also complicated in terms of customs law with its large number of imitations, because customs with its difficult declarations of goods under EU law often deviates considerably from the technical grouping. In the more than 40 years of our import activities, we have become acquainted with many possible and also impossible things - and in some cases we have had to pay very dearly. We are happy to place this wealth of experience at our customers' disposal.

Here is an example: In the course of the follow-up investigation of the AD586 anti-dumping case, the European Union found significant violations of the protective measures taken. A separate regulation (2019-2131) was published for this purpose.

We at Holst Porzellan sat on both sides of the table when working out conflict solutions - personally! Both in Brussels and in China. Therefore, we can justifiably state that the authorities are aware of many, really many ways of evading import duties. Their mills grind slowly, but they grind! So anyone who thinks he can manipulate manufacturer numbers or TARIC codes with cunning is in a risky position. Not only the company but also the responsible person in question assumes liability for this.

Anyone who has gone through such a procedure once thinks twice whether it is worth taking such a personal risk for a few percent better margin.

Hence our appeal: Don't be stupid and don't take such a risk just to get a pizza plate or a pastabowl cheaper against the competition! In Brussels the bad guys are all known!

OEM orders are not only a proven means to avoid manufacturing and procurement risks! It is the outsourcing of multi-layered import risks to companies that are specialists in this field.

But the liability risks do not stop after the procurement, but begin then only correctly. The marketing of porcelain and tableware with an own floor brand forces a clear legal position. Anyone who does not want to carry out the comprehensive product liability for food contact materials and articles, which is particularly valued in the EU internal market, needs an experienced and reliable partner.

We can do that, because that is our profession.
